Transgender Eqaulity Network

category national | rights, freedoms and repression | news report author Friday February 13, 2004 13:14author by Paul McAndrewauthor email ardhanishvara at hotmail dot com Report this post to the editors

TRANSGENDER EQUALITY NETWORK IRELAND > >PRESS RELEASE > Transgender Equality Network Ireland wishes to announce the launch of its public campaign for the full legal recognition of Transgendered people in their true gender.

The present Press Release follows the recent developments in the area of Transgender Rights in the European Court of Justice, the European Court of Human Rights as well as the United Kingdom, where the House of Lords just passed the Gender Recognition Bill introduced by the Government granting Transgendered people full recognition in law. Moreover, the public consultations in connection with the proposals made in the course of the long overdue Reform of the Irish Marriage Law are currently ongoing and item number 10 on the agenda of this Reform deals with "Transsexual Marriages" >which clearly indicates that the Government is starting to feel the pressure to change the presently unacceptable situation. The founders and members of Transgender Equality Network Ireland call upon the Government and, specifically, the Minister for Justice, Equality and Law Reform, to follow the High Court recommendations (obiter) made in case of Foy v. Ireland and introduce legislation ensuring that all rights guaranteed by the Irish Constitution and the European Convention on Human Rights Act 2003 may be enjoyed by all Transgendered people without any restrictions. We wish to draw the Minister¹s attention to the fact that Ms. Foy is currently appealing the High Court judgement to the Supreme Court. Subject to the outcome of these Proceedings the State may face a legal challenge in the European Court of Human Rights sooner rather than later and is very likely to be found to be in breach of various provisions of the European Convention on Human Rights 1950 which now does form an integral part of the domestic law in Ireland. As an Irish Transgendered person living abroad, I would like to offer my support where possible in supporting the Irish Transgendered community in attaining their full human rights and dignity, as engendered in current initiatives/legislation afforded by the European court of Human rights.

I live abroad and am reluctant currently to return to Ireland because of the current attitude/rights afforded to the transgendered that prevails there.

I changed my name and sex on my Irish passport recenlty but also feel that it is within my right to be able to change my Birth Certificate and marry. Either everyone has equal rights or no one has. This is the basic content of the legislation umbrellad within the European community and I don't see why the Irish goverment are about the last ones to realize this. Even a country as barbaric as the US that affords the death penalty realizes this.

Anyway My thoughts.
Best Regards and keep the light

hello,
i would like to point out that the irish government makes it even tougher to transition
by completely disregarding the fact that this is a serious issue in which many irish
trans people live (if such a thing can be called living) in fear for their safety and so most remain hidden in doors unable to go out side, this can take away a persons will to live,
WHY SHOULD WE BE LEFT IN A PRISON WHEN WE HAVE DONE NOTHING WRONG.
i have tried many times to get a response from the government only to be told there is nothing they can do.
below is a reply i got in june they say it is unsafe to operate, but is it not unsafe to be left in the dark when
a person is going insane due to lack of help in this country, plus they seem to forget that in order to get a place to live and a job,i would have to face a landlord and a interviewer both always end badly
leaving people like myself back at square one.iget 200 euros a week with this i gotta pay for everything because they will not provide for the doctors needed and then the wonder why there is so much crime,it is only a matter of time before some crazy person like me straps a bunch of explosives to themselves and walks into the main government building.
TIME WILL TELL!!!
SOME OF US HAVE NOTHING LEFT TO LOSE

Dear Ms McNamara

The Minister for Health and Children, Mary Harney, T.D., has asked me to
thank you for your recent letter concerning services for people with Gender
Identity Disorder (GID).

The Department of Health and Children has been represented on a group with
the JHSE, the Equality Authority and groups representing transgender
people. This group ran a seminar on the health needs of people with GID
which the Minister addressed.

This work has identified that there are some pioneer services developed for
people with Gender Identity Disorder in Dublin. Dr Jim Lucey in St
Patrick's hospital has been delivering psychological assessment and
confirming the diagnosis and Dr Donal O'Shea in St Colmcilles Hospital,
Loughlinstown, has been running endocrinology clinics to provide hormonal
therapy. Those who wish to undergo surgical reassignment currently attend
Charing Cross Hospital in London. The joint group has decided that it is
unsafe to plan to provide reassignment surgery in Ireland because the
numbers of patients are too small to develop adequate expertise and get
good outcomes.

Your general practitioner should be able to refer you to the assessment or
hormonal treatment services.

I hope this is helpful

Yours sincerely

Darragh Scully
Private Secretary
