Guantanamo detainees have constitutional rights

The US Supreme Court ruled Thursday that detainees held at Guantanamo Bay have the right to appeal their indefinite imprisonment without charges to US civilian courts

In a stinging rebuke to Bush's 'war on terror' the US Supreme Court has ruled that the kidnap victims at Guantanamo Bay Concentration Camp have the right to appeal the illegal detention to the Civil courts in the US. This may result in federal judges ultimately ordering the release of some detainees.

The ruling declares that the detainees have the same rights to contest their detention before a judge as anyone else in custody in the United States. Bush's administration had argued that the detainees have no rights.

The Supreme court has twice ruled that detainees can go into civilian courts to ask that the government justify their continued detention but on each occaision the administration and Congress changed the law to keep the detainees without legal recourse.

Lawyers for some detainees said hearings could take place within a few months. About 200 detainees have lawsuits on hold in the federal court in the US.

.”. Officials ( the President and some members of Congress) who are charged with daily operational responsibility for our security may consider …the history of the Habeas Corpus Act of 1679 and like matters to be far removed from the Nation’s present urgent concerns. Remote in time it may be; irrelevant to the present it is not." About time they started respecting their Constitution! Hopefully more bolder judgements will follow this one.

To avoid and accuse people without proof. To give heavy price to pay, before be sure to get the real culprit.

If there is only one thing to understand from Human Rights, it is this :
Avoid that anybody do what he wants to anybody else. Moreover if it is without proof he has done something evil !
"The family has not to pay in place of guilty", is hinted. This probably fit with all beliefs in World. In any case, it doesn't want and hurt these beliefs.

I would not be surprised to be in their lists, Redjade ! :-) :-{

With my critiques on everything, I am probably in or if not, Sarkozy will give my name between two embraces to his friends. ;-)
