Jump To Comment: 1The treatment of Magheraberry prisoners on Easter was dispicable.This type of treatment should be met with condemnation from across the political spectrim.It should without a shadow of doubt be much easier for Republicans of any section to add their condemnation and that is specifically aimed at constitutional Republicans.
However the suffering of inequality within the prison system of Republican prisoners is not only unique to six county jails or particular factions of Republican prisoners.This is one issue that unites all.For example Castlerea Republican prisoners have been persistantly denied temporary releases as a consequence of Justice Minister Michael McDowell envoking his "ministerial discretion".This is currently being challanged by Senior Council in Dublins High Court,however a positive outcome for the prisoners is unlikely and this will include the pre-release prisoner release programme enjoyed by all qualifying prisoners to prepare them for re-integration into society.
Also Republican prisoners affiliated to the Provisional movement in Port Laoise Prison are currently experiencing inequality in regards to temporary release in comparison to Republican prisoners from all other factions represented in the jail not to mention criminal inmates.
Following a prolonged protest in 04 by R.I.R.A prisoners an agreement was reached with prison authorities to establish a criteria for temporary release.
1.Death in immediate family.
2.Death of Grandparents.
3.Gravely or critically ill immediate family.
4.Communion or confirmation of son or daughter.
5.Wedding of son or daughter.
6.Birth of son or daughter.
7.Christening of son or daughter.
8.Pre-release programme
Each application for temporary release will be considered on its individual merits.The following 5 points will be taken into consideration before granting temporary release.
1.The nature of the offence.
2.Length of time spent in custody.
3.Threat to the community.
4.Behaviour while in custody.
5.The Minister when considering such applications will consider the prevailing security situation on the outside.
This agreement has been the basis of harmonious equal temporary releases for all Republican prisoners in Port Laoise Prison up until recently.It is the belief in particular of Provisional prisoners in Port Laoise whom have recently had two standard temporary release requests which qualify under the 04 agreement turned down that it is a form of punishment administered politically because Castlerea Republican prisoners dared to take the Minister to court.
One of the Port Laoise requests was an application for one day to attend a communion and the other for a specified period of hours to attend an exam to facilitate the entry of the applicant to a music course on release in Jan 08.In both cases Port Laoise Prison authorities supported the applications and expressed surprise on refusal.It is now the concern that all 7 Provisional prisoners will be subject to temporary release refusals including pre-release temporary release programmes.
Again this use of "ministerial descretion" is being used as a form of punishment and it is being administered externally over-riding the normal prison regime chain of command as per punishment administration to put it beyond an internal challange.This hawk type political interferance must be challanged by all Republican prisoners as it can be directed at any grouping at any time at The Ministers discretion.
