Freemasonry & Article 34.5.1 of Bunreacht na hEireann

category national | crime and justice | opinion/analysis author Saturday September 16, 2006 12:24author by W. Finnerty. Report this post to the editors

Is it possible to easily (and lawfully) find out if a particular person is a Freemason?

I realise it is possible to simply ask them; but, would this be permitted in a court room I wonder?

This point seems particularly important to me with regard to judges in the Republic of Ireland, who, under the terms of Bunreacht na hEireann (The Constitution of Ireland), have to take an oath requiring them to uphold the written Constitution of the Republic of Ireland.

Article 34.5.1 of Bunreacht na hEireann reads as follows:

"Every person appointed a judge under this Constitution shall make and subscribe the following declaration:

'In the presence of Almighty God I, --------- --------- , do solemnly and sincerely promise and declare that I will duly and faithfully and to the best of my knowledge and power execute the office of Chief Justice (or as the case may be) without fear or favour, affection or ill-will towards any man, and that I will uphold the Constitution and the laws. May God direct and sustain me.'

It is my understanding, and I hope someone will correct me if I am wrong, that Freemasons are required to take an oath which obliges them to uphold the principles of Freemasonry?

As reports I have read strongly suggest that the two sets of principles involved may well be completely incompatible in a number of very important respects, it seems to me that anybody appearing before a judge in the Republic of Ireland jurisdiction would, in the interests of justice, at the very least have a right to know whether or not the presiding judge is a Freemason?

I wonder what other people think regarding this particular point?
