Council's new dirty trick a major provocation.

Today in an area of Tallaght, South Dublin County Council carried out a major provocation in an attempt to intimidate thousands of householders to give up their campaign against the Councils bin tax.

Council officials went into Dunmore estate in the Kingswood area of Tallaght and, in many cases entered these private properties, and took away their refuse bins. Those householders were then given a written demand from the Council for the full arrears of bin tax demanded by the Council plus a fee of 100 Euros. This is a major provocation on behalf of the County Council in a naked attempt to break the huge resistance against the bin tax in the South Dublin area. Residents have now come out of their homes and are peacefully protesting and refusing to allow any more bins to be taken.

The Council's actions will now give rise to a major escalation in the campaign against the bin tax in South Dublin County Council. Emergency meetings will be held over the weekend in preparation for a stepping up of the campaign.

sure if your bins arent going to be collected because you wont pay for it whats the point in having a bin anyway. itll just get in the way.

did the council ever notify the residents "in writing" that the bins remained the property of the Council and could be withdrawn at any stage?
Did the Council notify the residents "in writing" and say something akin to "if you've any problems we will replace your bin"?
Did the council at any stage say "these bins are a service offered to you in return for payment?"

an update of this Hunnish matter and the thoughts of the residents would be appreciated.

did the body responsible for planning the introduction of pay for collection waste services properly state in the invitation to tender (that one presumes was as usual placed as an advertisement in the national broadsheet papers) inform the "pay for" collection company that they would have to furnish their prospective clients with bins? Or that their prospective clients would have to buy bins of their own to avail of private waste collection?

or will they have to be bought?
and did the council workers empty the confiscated bins before taknig them? OR did they in fact steal residents property?
Just because your property is in a waste bin that doesn't belong to you doesn't mean it ceases to be your property, If I put decent malt mash in a council bin on my private holding in the vital primary destilling stage to ferment a little, that mash is _my property_ and _on my property_ if the Council wish to _confiscate_ their property they have to _warn_ me first or they are guilty of _misappropriation_ of my property.
Though should I continue with my mashing and malt I too would be guilty of producing fortified liquor without a licence.

So:
Did any resident notice the Council "misappropriating" their property?
And can any of the legal beagles offer a definition of "waste"?
When do my empty milk cartons become "waste" and cease to be my property? I should think when and only when I place them on the common thouroughfare exercising my part in the common law contract to preserve hygeine, and indeed when the council collect said waste it becomes their property, but in what legal sense?
Do we give our waste to the council?
If say I am a slightly dippy little old lady that for fear of thieves has taken to keeping her bank documentation in a black plastic bin liner at the bottom of her bin, but it is on her property, what right do council workers have to enter that property?

Nothing else of consequence has happened in the world, and this is all I have really thought of for almost 48 hours.

from a resident of the said area of privately owned (some purchased from the Council who yeah assumed ownership of said from previous body), who expects a _handsome payout_ when her litigatious vigour (:-)) and insistence finally brings the Irish courts to answer one question (and thus to the angrandisement of the Irish Nation) set a European Precedent in legal, jurisprudence /"jurisprudent" [her name is Pru" and moral terms for the future of all.

& that question is "What is waste and when does it's value and worth alter and when may ownership be deemed to have passed from her little old sweet self and the agents of her local municipal authority".

She incidently has also allowed me to inform you (what a tippy toppy news service we provide) that she "the Mrs Pru" of Tallaght in the County of Baile Atha Cliath,
1. last year lost her wedding ring and thanks to the fine workers of Dublin council was given it back three days later after it had been taken from her home.
2. approves of Professor Chomsky of MIT being pied if he accepts the invite to address the forum of cultures next year as it isn't [in her words] {sic} "a forum at all it's more like a greenwich dome" (???!)
3. does not mind the odd sexist comment if it rymes and fits the purpose of the greater text.
4. feels "in her gut" {sic} that private waste collection is being prepared in the greater Dublin area and that it still remains quite unclear what contractual problems those corporations that bid for the forthcoming little rascals money spinning idea will have to pass to their hard working and incidently mostly anarchist legal teams.
5. Has taken in the last week to sneaking out of her house in the small hours and putting her rubbish in other double tax paying households "tort" waste receptacles.
6. she has talked to close friends about this.
7. she is not on drugs.

just to let people know non collection has started in Dun Laoghaire so far focused on a few routes that are mainly private houses/more prosperous - Killiney/Cabinteely area

Bins were also left behind in Mount Merrion and a few streets in Stillorgan. I also hear that Blackrock was also affected.

It is clear now that the council are trying to smash the campaing by picking off the areas in which there is majority payment. We NEED to show to the council that this tactic will not work. We need sharp quick and decisive action against the council as soon as possible.

Martin Cullen the FF Bin Tax minister will be attending a FF public meeting in UCD tonight at 7pm in the Arts Block. Anyone interested in showing up and letting you know how you feel about him?

After dithering for weeks about implementing non-collection its arrived in the leafy suburbs.

if you wait that long it all ready will be too late - people from several city areas WHERE BINS ARE STILL BEING COLLECTED were prepared to blockade as soon as non collection was implemented IN OTHER AREAS
- if we wait in Dun Laoghaire then they WILL pick us off one by one

- DON'T PLAY INTO THE COUNCILS HANDS BLOCKADE NOW !!

Our neighbours bin are not being collected, what is the responce of the SWP? Wait untill Thursday week and we'll discuss it!

The SWP are playing a disgusting role in the anti bin tax camapign in Dún Laoghaire Rathdown. Why are they argueing against blockades? Answer that please!

Council are threatening to withdraw collection from me (Fairview/Marino area) in two weeks if arrears are not paid in 14 days. They are also threatening us with use of a 'debt collection agency'. The letters are signed by a Terence G O'Keeffe, Law Agent

Conor if you want to organise blockades I would you suggest yopu contact the SP in the DLR area. I just can't understand why they are proposing to do NOTHING in DLR other than a publicity stunt about recycling on Saturday. When tested by having to organise effective protests they are no different to the Labour PArty, all talk absolutly NO ACTION. Its about time the SWP were kicked out of the leadership.

now they rival estate agents and money transfer services as being one of the most evil forms of capitalism the ordinary person (non-share holder) has to deal with.
Debt collection really is a section unto itself, I take pride in the fact that the debts I encurred whilst living (and litigating) in the UK were passed from one debt collection agency to another, if the DC agent can't get you to cough up, the debt becomes a "real loss" and is quickly "sold" to a larger debt collection company with supposedly "more clout" with which to pressure payment, and more importantly more capital with which to absorb your debt. This can end up being sort of perversely fun. The longer you owe money, the more irrelevant it becomes, the original creditor is paid by the first DC agent, the 2nd DC agent gets paid by the 1st, and in a few years, your debt oils mortgages and keeps people employed on a global scale. You progressively "owe" the same amount of money to richer and richer people till the stage someone decides to call it a day and give up sending you the letters. You then go into a very peculiar waiting period (in the UK of upto 8 years) whilst your credit black listing get's globalised, (no more bank loans in Singapore) and you find it harder to cash cheques. [Thus 4 million people in the UK have little or no financial service access]. It really is most ludicrous and very very weird. Because each DC agent theoretically makes a profit on your debt.
In some ways it mirrors on a microcosmic level the idiocy and unsustainablity of World Debt issues- Perhaps someone might write about Irish DC practise, as it may be different to UK practise, meanwhile, the "good thing" is they no longer break down your door, break your legs and lock you up in debtors prison. That said it can be stressful going, especially if you can't easily move home/country.
