Judgement in Dominic Dunne's case against Minister for the Environment.
Joint consent order. The decision to build the M 50 over the remains of
Carrickmines castle. The judgement in this case was deferred recently.
The date Mr Dunne was given for the hearing of the verdict is 7th March.
This was seen as a test of the constitutionality of the minister's decision to
invoke a section 14(a) 4 of the NMA 1930-2004 (as amended). Carrickmines ,
referred to as a national monument, approval for the road, therefore necessitated
a joint consent order, to remove section of the fosse and build over the castle remains.
This case will have repurcussions for other heritage sites, including The Tara complex.
the case was deferred on the day of the launch of the planning and development act 2006,
(The Strategic Infrastructure Bill). coincidentally.
